Terms of Service

---1. General TermsBy commissioning or purchasing artwork from Mayrisa (“the Artist”), the Client (“you”) agrees to the following Terms of Service (“TOS”).
These terms govern all illustration, character design, concept art, and related creative works created by the Artist.
Failure to read or acknowledge these terms does not exempt the Client from compliance.-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-2. Communication and Payment✦ All commissions and correspondence are conducted via email at [[email protected]].✦ Payments are accepted through PayPal (Invoice Only) in USD, DKK, NZD, unless otherwise agreed in writing.Full payment is required upfront before work begins, unless another payment plan has been expressly approved by the Artist in writing.✦ When a payment plan is granted, the remaining balance must be paid in full before the final artwork is delivered.
✦ The Client must provide clear, organized references and project details prior to commencement of work.
-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-3. Revisions✦ A sketch or composition preview will be provided for approval before rendering begins.✦ Minor changes (pose, expression, small adjustments) are allowed during the sketch phase.
✦ Major changes (composition, outfit redesign, or background changes) requested after sketch approval may incur additional fees.
✦ Once the final artwork is approved and delivered, no further edits will be made unless commissioned separately.-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-4. Refunds & Cancellations✦ Refunds are not available once work has begun, due to the time and effort involved in custom artwork.✦ If the Client cancels before work begins, a partial refund may be considered at the Artist’s discretion.✦ If the Artist must cancel the project, the Client will receive a full refund.✦ Chargebacks or payment disputes made without prior communication will result in revocation of all rights and permanent refusal of future commissions.-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-5. Copyright & Ownership✦ The Artist retains full copyright and moral rights to all works created, unless exclusive ownership is purchased under a separate agreement.✦ The Client’s rights are usage-based only and defined by the type of license purchased.✦ The Client may not:✦ Claim authorship or edit, trace, or modify the artwork without written permission.✦ Use the artwork for AI training, blockchain minting (NFTs), or other derivative technologies.✦ Remove the Artist’s signature or watermark.-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-6. Licensing and UsageEach artwork includes one license type.
All licenses are non-exclusive, non-transferable, and do not grant copyright ownership.
The following sections explain what each license allows and prohibits in detail.

Personal Use License (Default)Intended For: Individual, non-commercial enjoyment.Permitted:✦ Using the artwork as a profile image, banner, wallpaper, or personal print.✦ Sharing online (social media, personal galleries, etc.) with visible credit to the Artist (“Art by [Your Artist Name]”).✦ Personal portfolio display (for clients representing their commissioned character, not for professional advertising).Not Permitted:✦ Selling or profiting from the artwork in any form.✦ Using the artwork for branding, streaming, marketing, or business promotion.
* Including the artwork in monetized videos, merchandise, or crowdfunding campaigns.
This license is automatically included with every commission unless a commercial upgrade is purchased.-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-B. Commercial License – Streaming / Content CreationIntended For: Creators who monetize content (streamers, YouTubers, VTubers, etc.).Permitted:✦ Use in monetized livestreams, videos, or podcasts (e.g., Twitch, YouTube).✦ Display in stream overlays, background art, panels, intro/outro scenes, or channel branding.✦ Use in digital-only contexts where the artwork promotes or represents the client’s channel, persona, or brand.Not Permitted:✦ Printing or selling physical goods featuring the artwork.✦ Using the artwork in paid advertisements or sponsorships for third-party brands.✦ Reselling, sublicensing, or sharing the artwork for use by other creators.Fee: +50–100% of the base commission price (depending on scope and exclusivity).-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-C. Commercial License – Promotional / MarketingIntended For: Businesses, influencers, or organizations using the artwork for advertising or brand promotion.Permitted:✦ Use in promotional materials such as posters, banners, flyers, social media ads, or digital campaigns.✦ Use on company websites, event pages, or business profiles as part of brand identity.✦ Use in digital or printed marketing (non-merchandise).Not Permitted:✦ Printing the artwork on items for sale (merchandise).✦ Reselling or sublicensing the artwork to other parties.✦ Using the artwork as a core visual identity without credit or agreement for exclusivity.Fee: +100–150% of the base commission price (based on distribution and audience reach).-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-D. Commercial License – Merchandise / Product ResaleIntended For: Clients selling physical or digital products featuring the artwork.Permitted:✦ Printing the artwork on products such as apparel, prints, charms, stickers, posters, and other merchandise.✦ Use as promotional material in crowdfunding campaigns (Kickstarter, Patreon rewards, etc.) where products feature the artwork.✦ Use in packaging, product branding, or digital resale (e.g., downloadable prints or cosmetic game assets).Not Permitted:✦ Selling or distributing the artwork’s source file (PSD, transparent PNG, etc.).✦ Allowing third parties to use, modify, or distribute the artwork.✦ Claiming full ownership or authorship.Fee: +200–300% of the base commission price (depending on production volume and scope).-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-E. Exclusive Rights License (Optional)Intended For: Clients who wish to purchase complete ownership of the artwork.Permitted:✦ Full and unrestricted use of the artwork for any purpose, including resale, modification, and sublicensing.✦ Removal of credit upon request (though attribution is appreciated).Not Permitted:✦ Claiming the artwork was created by someone other than the Artist.✦ Retroactive exclusivity on previous, non-exclusive commissions.Fee: Negotiated case-by-case (typically 400–600% of the base commission price).
Upon full payment, the Artist relinquishes all usage and display rights, and copyright ownership is formally transferred in writing.

Delivery✦ Final artwork will be delivered digitally via email or a secure download link in PNG, JPEG, or PSD format.✦ The Artist is not responsible for file corruption, loss, or color discrepancies due to printing or screen calibration.✦ The Client should download and back up files promptly upon receipt.-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-8. Artist’s Rights✦ The Artist may display completed works in portfolios, social media posts, and promotional materials unless a confidentiality agreement is established.✦ The Artist reserves the right to refuse, cancel, or terminate a commission for any reason (e.g., harassment, inappropriate content, breach of terms).✦ Prices and terms may be updated at any time for future projects, but active commissions remain bound to the terms agreed upon at payment.-. ݁₊ ⊹ . ݁ ⟡ ݁ . ⊹ ₊ ݁.-9. AgreementBy commissioning Mayrisa, the Client acknowledges that they have read, understood, and agreed to these Terms of Service in full.
Violation of these terms may result in legal action, revocation of rights, or denial of future services.
